Pre-Employment Drug and Alcohol Tests
Employers are required to conduct pre-placement drug testing on prospective CMV drivers before completing the hiring process (49 CFR Part 382.301). An employer is not required to but may conduct pre-placement alcohol testing (49 CFR 382.301).
Random Drug and Alcohol Tests
Random drug and alcohol tests are an important part of maintaining regulatory compliance. DOT regulations require employers to conduct random screenings periodically, without prior notice to employees (49 CFR 382.305).
Post-Accident Drug and Alcohol Tests
Post-accident drug and alcohol testing is required whenever a CDL driver is involved in a fatal accident, or after they receive a traffic citation resulting from an injury or a vehicle-disabling accident. The alcohol test must occur within 8 hours, and the drug test within 32 hours (49 CFR 382.303).
Return-To-Duty Drug and Alcohol Tests
Employees who have violated DOT drug and alcohol regulations are required to undergo return-to-duty drug and alcohol tests before resuming duties (49 CFR 40.305). This test cannot occur until the employee has completed the “return-to-duty” process as outlined in 49 CFR 40.305.
